Solid Waste Rates
In accordance with the Franchise Agreement between Castro Valley Sanitary District and Alameda County Industries (ACI), the corresponding updated rates will be effective beginning July 1, 2020.


Special Assessment Process for Delinquent Accounts
Castro Valley Sanitary District (CVSan) is exercising the Special Assessment process to collect delinquent solid waste (recycling, organics, and garbage) service charges and notified all commercial and multi-family property owners of its effective date of May 1, 2019 and single-family property owners of its effective date of July 1, 2012. 

Approximately 2 percent of the CVSan community is delinquent in their payment to the contracted hauler for services. Starting May 1, 2019, Alameda County Industries (ACI) will begin providing solid waste collection and processing services. In order to ensure that all residents pay for their fair share for services, unpaid bills past due 120 days will be subject to the Special Assessment process and placed on the Alameda County property tax roll. 

Prior to unpaid amounts being placed on the Alameda County property tax roll, CVSan Code Article V, Chapter 6 has established that 30-day, 60-day, and 90-day notices will be mailed to the property owner by ACI requesting payment, and bills unpaid after 30 (commercial and multi-family) or 45 days (single-family) will be assessed a 1.5% late fee per month.  In addition, ACI will send a 120-day Delinquency Subject to Special Assessment notice.  CVSan will send a Final Request for Payment and Notice of Administrative Hearing letter which will include the date, time and location of the actual Hearing. The amount to be assessed on the Alameda County property tax roll will include all delinquent charges as of May 31st of each year, the actual costs of assessment and collection of the delinquent charges on the tax roll, and an administrative fee of $50.00.

Generally, if you have been paying your bill, you do not have a Delinquent Account and you will not be receiving collection notices.

For 2019/20, a Final Request for Payment & Notice of Administrative Hearing was mailed on May 7, 2020. To avoid this Special Assessment and additional fees on your Alameda County property tax bill, please remit payment. ACI must receive payment by 4:00 p.m., Friday, May 29, 2020 at 610 Aladdin Avenue, San Leandro, CA 94577. Payment received after 4:00 p.m. on Friday, May 29, 2020 will not be applied toward the delinquent charges.

Administrative Hearing
CVSan’s Board of Directors will conduct an Administrative Hearing at a Regular Meeting of the Board on July 7, 2020. To request a hearing by the Board, please complete and submit the Request for Administrative Hearing form by 2:00 p.m., Friday, June 5, 2020 to CVSan offices located at 21040 Marshall Street, Castro Valley, CA 94546. A request must be filed by the deadline or the right to protest/object the delinquent charges will be considered waived. Requestors will be notified by phone about details of the Administrative Hearing by June 19, 2020. The Request for Administrative Hearing Form can be found at the bottom of this page.

Please note that due to orders (Federal, State, and County) related to COVID-19, CVSan offices may be closed for in-person delivery of Request for Administrative Hearing forms and applicable documents. Documents must be mailed to CVSan or dropped through the mail slot by the front door at 21040 Marshall Street, Castro Valley, CA 94546 by the filing deadline. It is the requestor’s responsibility to ensure that documents are delivered by the deadline. CVSan encourages requestors to submit their documents as early as possible.

Q:         Why am I receiving a letter dated May 7, 2020 entitled “Final Request for Payment & Notice of Administrative Hearing”?
A:         All property owners who have delinquent solid waste (recycling, organics & garbage) service charges 120 days past due received a notification letter from CVSan to notify them of past due charges on a property that they own within CVSan boundaries.

Q:         I don’t receive a bill from Castro Valley Sanitary District (CVSan), do I?
A:         No, you don’t receive a bill from CVSan for solid waste (recycling, organics & garbage) services. Starting May 1, 2019, CVSan contracts with Alameda County Industries (ACI) who provides solid waste services; you will receive bills from ACI.

Q:         Who do I talk with about my delinquent account?
A:         For bills from ACI at 510-483-1400 or email BillingCV@alamedacountyindustries.com.

Q:         This is the first time I’m hearing about this. When did CVSan notify property owners?
A:         CVSan sent a letter dated May 21, 2012 entitled “Notification of Special Assessment Process” to all single-family property owners and March 7, 2019 to all commercial and multi-family property owners. In addition, there have been articles in the CVSan Pipeline Newsletter, and ACI sends 4 notices to the billing address and property address entitled, “Delinquency Subject to Special Assessment” for accounts that were 30, 60, 90, and 120 days past due. Information is available in our Code and on our website.

Q:         I’m the property owner but my tenants are responsible for paying the garbage bill. I didn’t know they weren’t paying so I shouldn’t be held responsible.
A:         The property owner is ultimately responsible. CVSan Code Article V, Chapter 6 states, “…failure of the owner to receive any such bill shall not relieve the owner of the premises from the obligation of paying the charges due.” The property owner has the ability to determine where the bill is sent.

Q:         How does CVSan have the authority to put a Special Assessment on my property tax roll?
A:         CVSan Code Article V, Chapter 6 is available for viewing here. The Special Assessment process is effective July 1, 2012 for single-family and effective May 1, 2019 for commercial and multi-family property owners. 

Q:         Can I come down to CVSan offices and pay my bill?
A:         No, payment for bills from ACI must be received at the ACI office at 610 Aladdin Avenue, San Leandro, CA 94577.

CVSan Public Hearing & Rate Increase for Solid Waste Services

NOTICE IS HEREBY GIVEN that the Castro Valley Sanitary District (CVSan) will hold a Public Hearing at the Board of Directors Meeting on February 5, 2019, at 6:30 p.m. in the CVSan Board Room, located at 21040 Marshall Street, Castro Valley, CA 94546, to consider the adoption of increases to the rates for solid waste service fees to the property address for which you are shown as the record owner.

The purpose of the hearing is to consider all written protests and hear and consider all oral comments against the proposed rate increases.  As the owner of property identified to be subject to the proposed rate increases, you may submit a written protest against the proposed rate increases.  If the identified property has more than one owner, only one written protest will be counted.  To qualify, each protest must: (1) be in writing; (2) state the protest is being submitted in opposition to the proposed rate increases; (3) provide the location of the identified property (by street address); and (4) include the original signature of the property owner submitting the protest.  Protests submitted by e-mail, facsimile, or other electronic means will not be accepted.  Written protests may be submitted by mail or in person to: Castro Valley Sanitary District, 21040 Marshall Street, Castro Valley, CA 94546, or at the public hearing, so long as they are received prior to the conclusion of the public comment portion of the public hearing.  Please identify on the front of the envelope for any protest, whether mailed or submitted in person, Attn: Public Hearing on Solid Waste Services Rates.  At the conclusion of the Public Hearing, the Board will consider adopting the proposed rate increases for solid waste service. REASONS FOR THE PROPOSED RATE INCREASES: CVSan entered into a 10-year Collection and Processing Agreement with Alameda County Industries (ACI) to provide municipal solid waste (recycling, organics, and garbage) services, effective May 1, 2019, for CVSan.  Pursuant to the agreement, ACI has agreed to provide these services at specific rates for different customers within CVSan’s service area.  The rates are subject to an annual adjustment set by the Board at an annual public meeting prior to each July 1. 

BASIS UPON WHICH THE RATES ARE CALCULATED: The rate structure for solid waste service fees is comprised of three customer classes: (1) single-family residential, (2) multi-family residential, and (3) commercial. Single-family residential customers are provided three solid waste carts – recycling, organics, and garbage.  The fees for single-family residential customers are determined on the basis of the size of the garbage cart (in gallons) serving a property and the type of service provided (ex., curbside service or backyard service). They are also charged an additional fee if they request an additional cart (referred to as extra curbside or backyard service) or other service.  Multi-family residential and commercial customers are similarly charged based on the size of the first type of solid waste cart (in gallons) or bin (in cubic yards) of a two or three-cart or bin bundled service (ex., a two-bin bundle could include 1 x 2 cubic yard recycling and 1 x 2 cubic yard organics bin).  They are also charged based on the size of compactor (in cubic yards) or drop box (in cubic yards), and the size and type of service provided (ex., garbage only; recycling only; organics only; additional pickups per week or of extra items; push services; roll-off-services; and other ancillary/special services).

Maximum proposed monthly rates for 1x/week solid waste services and ancillary fees, if adopted, and the effective dates for their implementation are listed in the notification below. 

Actual annual rate increases will be calculated in accordance with the agreement with ACI using a Rate Adjustment Methodology, Index-Based Adjustment Methodology, Cost-Based Adjustment Methodology, or Recyclable Processing Cost Adjustment Methodology, depending on the year through June 30, 2024, and will not exceed the maximum proposed monthly rates set forth in the notification below.
